Service Description

infrahubluae provides construction schedule delay analytics dashboards and related services to construction companies and professionals. Our services include custom dashboard development, real-time project monitoring, predictive analytics, and training services designed to help construction companies optimise their project delivery and reduce delays.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with appropriate notice to existing clients.

User Obligations

When using our website and services, you agree to:

• Provide accurate and complete information when requested
• Use our services only for lawful purposes and in accordance with these terms
• Not interfere with or disrupt our services or servers
• Not attempt to gain unauthorised access to our systems or data
• Respect the intellectual property rights of infrahubluae and third parties

You are granted a limited, non-exclusive, non-transferable licence to use our services in accordance with these terms. You may not copy, modify, distribute, sell, or lease any part of our services or included software, nor may you reverse engineer or attempt to extract the source code of our proprietary algorithms.

Data and Confidentiality

We understand that your construction project data is sensitive and valuable. We commit to:

• Maintaining strict confidentiality of all client project data
• Implementing appropriate security measures to protect your information
• Using your data only for providing and improving our services
• Not sharing your data with competitors or unauthorised third parties

You retain ownership of your project data and grant us permission to process this data for the purpose of delivering our analytics services. Our data handling practices are detailed in our Privacy Policy.

Payment Terms

Payment terms for our services are specified in individual service agreements or proposals. Generally:

• Fees are payable in Euros (EUR) unless otherwise agreed
• Payment is due within 30 days of invoice date unless otherwise specified
• Late payments may incur interest charges as permitted by law
• We reserve the right to suspend services for overdue accounts

All prices are exclusive of VAT and other applicable taxes, which will be added where required by law.

Limitation of Liability

To the maximum extent permitted by law, infrahubluae's total liability for any claims arising from or related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim in the 12 months preceding the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.

Our analytics and predictions are based on historical data and statistical models. While we strive for accuracy, we cannot guarantee that our predictions will prevent all project delays or ensure specific project outcomes. Construction projects involve numerous variables beyond our control.

Service Availability

We aim to provide reliable and continuous access to our services, but we cannot guarantee uninterrupted availability. Our services may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.

We will make reasonable efforts to provide advance notice of planned maintenance that may affect service availability.

Governing Law

These terms are governed by and construed in accordance with the laws of the Republic of Slovenia. Any disputes arising from or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts of Slovenia.

If you are a consumer resident in another EU member state, you may also have rights under the laws of your country of residence, and nothing in these terms affects those rights.

Termination

Either party may terminate the service relationship with appropriate notice as specified in the individual service agreement. We may immediately terminate or suspend your access to our services if:

• You breach these terms of service
• You fail to pay fees when due
• Your use of our services poses a security risk
• We are required to do so by law

Upon termination, your right to use our services will cease immediately. We will provide reasonable assistance in data export for a limited period following termination, subject to our data retention policies.

Force Majeure

infrahubluae shall not be liable for any failure or delay in performance under these terms which is due to fire, flood, earthquake, elements of nature, acts of God, acts of war, terrorism, riots, civil disorders, rebellions, or other similar causes beyond our reasonable control.

Modifications to Terms

We may update these terms from time to time to reflect changes in our services, business practices, or legal requirements. We will notify you of material changes by posting the updated terms on our website with a new effective date.

Your continued use of our services after any modifications constitute your acceptance of the updated terms.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms will remain in full force and effect.
